1. Introduction and Purpose
JMB TECHNOLOGY LTD ("we", "us") provides the CallPlatform service (the "Service") to our customers. This Fair Use Policy (FUP) is designed to prevent fraud and abuse of our services by a small number of users. The FUP ensures that all our customers receive a high-quality, reliable service by outlining the guidelines for acceptable use.
This policy applies to all plans, including those with bundled or "unlimited" components, which are always subject to fair use.
2. Scope of this Policy
This FUP covers the following aspects of the Service:
- Bundled Call Minutes
- Concurrent Call Channels
- Call Recording and Data Storage
- Prohibited Uses
Bundled Call Minutes
Where our plans include a bundle of call minutes, these are intended for normal, person-to-person business conversations. Usage patterns that are not considered normal business use include, but are not limited to:
- Operating a call centre or telemarketing business where call volumes are consistently high and sustained.
- Use of automated dialing systems (auto-dialers, predictive dialers) to make large volumes of outbound calls.
- Call forwarding or "daisy-chaining" services for the primary purpose of masking call origins or arbitrage.
- Continuous or excessive machine-to-machine communications.
If a customer's usage significantly exceeds the average usage of other customers on similar plans, we reserve the right to review the account and discuss a more suitable high-volume plan.
Concurrent Call Channels
Each phone number is provisioned with a default number of concurrent call channels (typically 2-5) to handle simultaneous calls. This is sufficient for most standard business use cases. If you require a higher number of concurrent channels for a specific number (e.g., for a busy contact centre), please contact our sales team to arrange a custom plan.
Call Recording and Data Storage
Our platform provides storage for call recordings, transcripts, and other data. Our standard plans include a default data retention period (e.g., 30 days). Data stored beyond this period may be automatically deleted. We are not liable for the loss of data that exceeds the retention period of your plan. For customers requiring long-term archival, we offer options to deliver recordings to your own storage solutions (e.g., AWS S3, SFTP). Consistently storing an excessive volume of data may require an upgrade to a custom storage plan.
Prohibited Uses
You may not use the Service for any illegal, fraudulent, or abusive purposes. Prohibited uses include, but are not limited to:
- Transmitting any material that is harassing, defamatory, fraudulent, or otherwise illegal.
- Engaging in spamming, "phishing," or sending unsolicited messages or calls in violation of applicable laws (e.g., TCPA).
- Using the service to test or flood telecommunication networks.
- Attempting to breach the security of the platform or any other user's account.
- Reselling the service without explicit written permission under a formal Reseller or Whitelabel agreement.
3. Breach of this Policy
If we determine, at our sole discretion, that your use of the Service is in breach of this FUP, we will typically take the following steps:
- We will attempt to contact you to discuss your usage and understand your needs.
- We may request that you modify your usage to comply with this policy or upgrade to a more appropriate plan that accommodates your usage patterns.
- If the breach continues or is deemed severe, we reserve the right to suspend or, in extreme cases, terminate your access to the Service without prior notice.
4. Changes to This Policy
We may revise this Fair Use Policy at any time. We will post the revised version on our website and update the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new FUP.
