These are general website and service terms. A signed order form, partner agreement, master service agreement, data-processing agreement or service schedule may apply additional or different terms. Where they conflict, the signed agreement takes priority.
1. Agreement
By accessing or using CallPlatform or another service supplied by JMB Technology Ltd (“JMB”, “we”, “our” or “us”), you agree to these terms and any service-specific terms presented to you. If you use the service for an organisation, you confirm that you have authority to bind it.
2. The service
CallPlatform provides telecommunications, call routing, account administration, reporting, automation, AI and related services. The features available to you depend on your account, commercial package, deployment, region, provider configuration and any signed agreement.
We may improve, replace or discontinue features. We will handle material changes to a contracted service in accordance with the applicable agreement. Public demos use synthetic data and are illustrative; they do not create an account or carry live calls.
3. Accounts and security
You must provide accurate information, keep account details current and protect credentials, recovery codes and connected-system secrets. You are responsible for authorised users and for promptly removing access that is no longer needed.
You must notify us promptly if you suspect compromise or unauthorised activity. We may require multi-factor authentication, restrict access or take protective action where reasonably necessary for platform, customer or network security.
4. Acceptable and lawful use
You must use the service lawfully and must not:
- make unlawful, fraudulent, abusive, harassing or deceptive communications;
- conduct automated calling, marketing or messaging without the consent, notices and screening required by applicable law;
- spoof caller identity, misrepresent your organisation or evade network safeguards;
- upload malicious code, attack the service, attempt unauthorised access or interfere with other users;
- use numbers, recordings, data, content or connected systems without the rights and lawful basis required; or
- use the service for emergency calling, safety-critical automation or a regulated workflow unless the applicable service and contract expressly support it.
You remain responsible for your call scripts, campaigns, contact lists, disclosure, consent, recording, retention and sector-specific obligations.
5. AI, speech and automated decisions
AI and speech features can produce incorrect, incomplete, delayed or unexpected results. You must select appropriate use cases, instructions, knowledge, permissions, fallbacks and human escalation. Do not rely on an AI response as professional, medical, legal, financial, emergency or safety-critical advice.
You are responsible for telling callers when required, obtaining necessary consent, reviewing sensitive workflows and ensuring that connected actions do not exceed the authority you intend to grant. Provider availability, model behaviour and supported languages can change.
6. Integrations and customer systems
If you connect a carrier, CRM, calendar, booking system, API, AI provider or other third-party service, you authorise the data exchange needed for the configured feature. You must hold the necessary rights and credentials and comply with the provider’s terms.
Third-party services are outside JMB’s direct control. A failed, delayed or changed provider may affect a call journey. Important flows should use the timeout, error, fallback and idempotency controls appropriate to the action.
7. Charges, prepay and payment
Charges, billing frequency, included usage, rates, minimum terms and payment method are set out in the applicable order, catalogue or portal offer. Taxes may apply. Usage-based services are charged from authoritative platform records subject to the agreed rating rules.
Prepay credit, package allowances and renewal behaviour are shown in the applicable account and offer. A package may have eligibility, fair-use, overflow, renewal or cancellation conditions. Unless the applicable agreement states otherwise, credit is not a bank deposit, does not earn interest and is not transferable between unrelated accounts.
We may restrict or suspend chargeable service where credit, package allowance, payment or authorisation is insufficient, or where continued service creates unacceptable fraud or financial risk.
8. Intellectual property
JMB and its licensors retain all rights in CallPlatform, the website, software, designs and documentation. You retain rights in your content and grant us the limited rights needed to provide, protect and support the service.
You must not copy, reverse engineer, resell, sublicense or create derivative platform services except as expressly permitted by a partner or other written agreement.
9. Availability, suspension and termination
Telecommunications and cloud services can be affected by carriers, internet routes, customer equipment, third parties, planned maintenance and events outside reasonable control. Any service level or support commitment applies only when stated in a signed agreement.
We may suspend access for a material breach, unlawful use, security threat, fraud risk or non-payment. Either party may terminate in accordance with the applicable agreement. On termination, charges already incurred remain due and data handling follows the contract and legal retention requirements.
10. Warranties and liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, the service is provided with the commitments expressly stated in the applicable agreement, and implied warranties are excluded to the maximum extent permitted by law.
To the maximum extent permitted by law and subject to any signed agreement, JMB is not liable for indirect or consequential loss, loss of profit, revenue, goodwill or anticipated savings. Contract-specific liability caps and exclusions take priority where agreed.
11. Governing law
These terms and any non-contractual dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, unless a signed agreement states otherwise.
